Na een onrustige nacht werd ik wakker in mijn logeerkamer. Ik keek door het raam en het eerste dat mijn vermoeide ogen zagen, was een camera die mij levenloos aanstaarde. Opeens was alles daar terug, het checkpoint, het lange wachten, de taxirit naar hier… En dan het huis, eigenlijk een doodgewoon Arabisch huis, gebouwd met die typische grote witte natuurstenen. Maar zo doodgewoon was het huis in feite niet. Dit huis was langs drie kanten volledig omringd door een grote, acht meter hoge betonnen muur.
In de zomer van 2010 ben ik voor vier weken naar Palestina gereisd, omdat ik ervan overtuigd was dat een reis naar die regio onontbeerlijk is om de realiteit daar te kunnen vatten. Ik heb toen vier nachten in het huis van Claire Anastas in Bethlehem gelogeerd. De gastvrijheid van de familie Anastas stond in schril contrast met het gevoel van onmacht dat elk menselijk wezen overvalt bij het zien van deze trieste situatie.
Ooit was dit huis gelegen op de drukke levensader tussen de heilige steden Jeruzalem en Bethlehem. Door de bouw van de muur tussen Israël en de bezette Palestijnse gebieden in 2002, is deze verbindingsweg nu dood. Geen mens waagt zich nog in deze verre uithoek die door de kronkelende muur gevormd werd.
Ik heb mijn masterproef over een internationaal relevant en actueel onderwerp geschreven. De 707 kilometer lange muur heeft elke dag weerslag op de gehele Palestijnse bevolking in de Westelijke Jordaanoever. In de Westerse wereld is het bestaan van de muur genoegzaam bekend, maar de implicaties die de constructie heeft voor mensen die er elke dag mee geconfronteerd worden, zijn als buitenstaander niet te vatten.
Ik vond het belangrijk om voor het onderzoek naar de bezette Palestijnse gebieden te reizen, om de situatie zelf te beleven en omdat ik nood had aan directe informatie van de plaatselijke bevolking. Ik ben in Ramallah, op de Westelijke Jordaanoever, ingetrokken bij een familie. Ik ben van daaruit naar verschillende bezette Palestijnse steden (Hebron, Nabloes, Bethlehem, Jericho en Oost Jeruzalem) en dorpen (Qalandia, Bil’in) gereisd. Ik heb daar met Palestijnse boeren gepraat, met jongeren die elke dag naar school moeten via de gateways in de muur, en met een meisje van mijn leeftijd, geboren in Jeruzalem, dat zo graag nog eens de kans zou krijgen om haar geboorteplaats te bezoeken.
Ik heb gesprekken gevoerd met een van de schepenen van Bil’in, de heer Abu Rahme. Hij vertelde mij het relaas van de onteigeningen door het Israëlische leger en hoe ongeveer de helft van het grondgebied van het dorpje momenteel aan de andere kant van de muur ligt. Ik heb gesproken met vertegenwoordigers van verschillende Israëlische en Palestijnse organisaties zoals B’tselem, HaMoked en Al Haq. Bij hen heb ik zeer veel nuttige informatie kunnen verzamelen, in de vorm van studies, rapporten en artikels.
Als juriste heb ik een onderzoek gedaan naar de verschillende juridische beslissingen die met betrekking tot de muur geveld werden. Het is vanzelfsprekend dat burgers die zich geschaad achten door de handelingen van een overheid, zich zullen wenden tot de rechtbank om voor hun klachten een oplossing te vinden. Dit is precies wat de Palestijnse burgers hebben gedaan.
In de eerste plaats hebben Palestijnse boeren, die door de bouw van de muur geen onmiddellijke toegang meer hadden tot hun landbouwgronden, verzoekschriften ingediend bij het hoogste Israëlische gerechtshof, de High Court of Justice.
Er is echter ook een mensenrechtenbeweging die geijverd heeft voor een behandeling van de kwestie door het Internationaal Gerechtshof in Den Haag. In 2004 heeft dat Hof een advies gegeven over de legaliteit van de Muur in de Westelijke Jordaanoever en Oost-Jeruzalem en de gevolgen die de muur heeft voor de bevolking van de bezette Palestijnse gebieden.
Het naast elkaar bestaan van die beide soorten juridische beslissingen met betrekking tot hetzelfde onderwerp, de Muur in de bezette Palestijnse gebieden, trok mijn aandacht en heeft mij nieuwsgierig gemaakt naar de onderlinge relatie tussen beide. Waar zitten de verschillen en gelijkenissen tussen deze rechterlijke beslissingen? Een rechterlijke beslissing moet vanzelfsprekend objectief zijn. Toch zijn de beide rechterlijke instanties niet tot hetzelfde besluit gekomen. Hoe komt dat? Wat zijn daar de dieperliggende oorzaken van?
In mijn masterproef heb ik deze vragen beantwoord. De resultaten werpen een verhelderend licht op de denkwijzen van het Israëlische leger en de Israëlische overheid en samenleving.
